v2.1

Effective date

8 October 2026

Important: Closing an account does not automatically reverse a separate purchase; mandatory refunds and properly cancelled future renewals remain available.

1. Scope and interpretation

This Cancellation Policy explains the ways DateFoundry users can close an Account, end access to the Service, terminate future charges under any separately offered paid membership and exercise applicable statutory cancellation rights. DateFoundry is operated by AMORIAX LTD and provides adult dating features with optional paid tokens, packs of likes and virtual gifts. These activities are different legal transactions: cancelling a future subscription renewal is not the same as reversing a delivered digital-item purchase, and deleting an Account is not automatically a refund request.

This Policy must be read alongside the Terms & Conditions, Refund Policy, Payment Policy and Privacy Policy. We aim to make closure and cancellation routes accessible and not to use account termination to avoid obligations for undelivered or nonconforming digital content. Mandatory consumer protections remain in force whether a customer is still registered or has ceased using the Service.

2. Nature of the Service and purchases

An Account allows a person aged at least 18 to create a profile, search for others, communicate through available tools and exercise purchased in-platform actions. Tokens, likes and virtual gifts are licensed digital functionality, not cash, investments or funds kept for withdrawal. The purpose of a paid gift is to transmit the described digital expression; it does not buy a response, a date or another member's consent. These purchases are typically one-time orders for specified digital units.

A separately advertised Paid Membership may provide time-based features if purchased through a distinct ordering process. It must disclose the price, billing interval, minimum term where relevant, renewal status and cancellation route before payment. Nothing in the acquisition of a one-time token or gift pack creates a continuing charge authority. If membership access is not offered, the recurring-billing provisions of this Policy do not create a subscription product.

Closing a dating profile, cancelling a pending order under a statutory right, terminating a service and instructing a merchant not to renew a paid membership are different legal actions. We handle each expressly identified instruction on its own terms. A customer can request more than one outcome in the same message, but an account closure must not be interpreted as a general waiver of refund, access or privacy rights.

3. Ways a user may cancel or close an account

A user may use an available Account closure control or contact info@datefoundry.com from the registered email address requesting termination of access. If the Account interface includes a distinct “Manage Membership” or billing cancellation function, it should be used to stop a separately authorised renewal; contacting support remains an available route when an online control is inaccessible. State clearly whether you wish to close the entire Account, cancel future membership renewals, exercise a statutory cancellation right concerning a particular purchase or request personal-data erasure.

We may request reasonable verification before closing or making financial changes to protect against malicious requests. An Account closure request should identify the Account but should not require a password or complete payment-card number in an email. A customer who cannot sign in can still contact support and explain the access problem. We confirm the action taken and any separate payment or data process that remains open.

Where a separately contracted paid membership renews, a request to stop future renewal can be submitted by email without buying anything or contacting another member. A self-service setting, if offered, is additional to this support route. We will confirm the membership or order affected and the effective date of the cancellation; the customer should not be forced to delete the entire dating profile solely to stop a future membership charge.

4. Effective time of a user cancellation

An authenticated request to stop a future membership renewal should be processed so that no charge becomes due for a later renewal period after effective cancellation, subject to the disclosed contractual timing and mandatory law. Customers should receive an acknowledgement and retain a record. Where a membership period has already been paid for, cancelling renewal may allow access until that period ends unless the user also closes the Account immediately or a statutory remedy dictates otherwise.

Voluntary Account closure ordinarily becomes effective after proportionate identity checks and confirmation of the requested action. We aim to acknowledge within two Business Days and complete a straightforward closure within ten Business Days after sufficient verification, while explaining any lawful preservation of financial or safety records. If an imminent renewal requires urgent intervention, the customer should explicitly identify it so support can prioritise stopping a further payment.

For a clear and verifiable instruction not to renew, we will act on it without avoidable delay so that a future charge does not arise from our failure to process the instruction. If a payment was taken after an effective cancellation because of our error, we will review it as an incorrect charge and provide the legally appropriate remedy. A request received during a statutory cancellation period is assessed by its receipt date, not by the eventual completion of internal administration.

5. Consequences of voluntary closure

Closing an Account ends the licence to use its private profile, communication functions and remaining in-platform digital entitlements. Unused tokens, remaining likes and unsent virtual gifts ordinarily cease to be usable and cannot be transferred to another Account or redeemed for cash. Information already sent to another member cannot always be retrieved from that person's possession. Before submitting a closure request, check whether you wish to save permitted information, resolve a pending purchase or send a separate statutory rights request.

Account closure does not erase the fact that a valid payment was made or extinguish an existing claim against the seller. Transaction, tax, safeguarding or dispute evidence may be retained where there is a legal basis, as explained in the Privacy Policy. If a pending refund involves credits in a closed Account, the financial review continues independently and any appropriate credit or reversal is reconciled in the payment ledger.

The loss of access to already-sent messages may affect other members, and closure cannot guarantee deletion of material that another user has lawfully retained. It does not authorise DateFoundry to sell or transfer the member’s unspent virtual balance. Data erasure is processed under the Privacy Policy, while the cancellation record and payment ledger may remain where necessary for legal compliance or dispute resolution.

6. No automatic refund on cancellation

A voluntary decision to stop using a dating service is not, by itself, evidence that a previously supplied digital item was faulty or undelivered. Once a purchased entitlement has been validly supplied and used as described, a discretionary refund is not automatic. Likewise, sending a virtual gift without obtaining a romantic response does not make the purchase defective. Any applicable 14-day cancellation right, faulty-content remedy, delivery-failure remedy or unauthorised-charge claim is evaluated under its own conditions.

For a separate Paid Membership, the effect of cancellation on a paid period depends on the disclosed contract and applicable law. A future-renewal cancellation should prevent charges for a later period; it does not necessarily result in a pro-rata refund for an already commenced lawful service period. The Refund Policy describes the analysis and timetable when money must be returned.

7. Company-initiated suspension, restriction and termination

DateFoundry may suspend specific features or an Account to investigate threats, harassment, fake identities, underage participation, payment fraud, content exploitation or a significant security breach. Controls should be proportionate to the risk and may be applied rapidly where waiting creates imminent harm to another member. We review available evidence and, where safe and lawful, communicate a meaningful explanation and a path for challenging mistakes. A safety suspension differs from a final decision that a purchase was lawfully forfeited.

A permanent termination may follow a serious or repeated material breach, lawful authority demand or withdrawal of a Service that can no longer operate. We consider outstanding paid obligations and any relevant consumer remedies before finalising the financial outcome. The ability to remove unlawful content or protect other users does not justify keeping payment for a product that the operator failed to supply as required by law.

When suspension is caused by an abuse report rather than established wrongdoing, we may impose temporary and proportionate protective limits while checking relevant evidence. A restriction must be distinguishable from the final decision to terminate a contract. If the restriction was erroneous and materially deprived a paying consumer of a contracted benefit, an appropriate restoration or statutory remedy may be required.

8. Fraud, abuse and disputes

Where there is a credible report of account takeover, unauthorised spending or ledger manipulation, we may temporarily freeze account actions, prevent further purchases or hold suspect credits while investigating. Evidence can include order status, device and login records, entitlement history and communications relevant to the complaint. We distinguish deliberate misconduct from a genuine payment failure, an error in a third-party provider or a member exercising a legal right.

Opening an honest card dispute or requesting a refund is not grounds for automatic permanent suspension. We may contest inaccurate chargebacks with authentic evidence, but we do not require withdrawal of a legitimate scheme complaint as a condition of service. Accounts used to obtain stolen payment benefits or duplicate gifts through an exploit may be restricted and wrongfully created entitlements reversed, subject to a fair assessment and the rights of an innocent buyer.

9. Treatment of tokens, likes, gifts and digital entitlements

Tokens, unused likes and virtual gifts belong to the limited licence of the original purchaser's Account. On voluntary closure, they are ordinarily extinguished rather than paid out, sold or transferred. A recipient of a gift does not obtain a cash-redeemable balance and cannot demand reimbursement of the purchase price from DateFoundry merely because a gift was received. The existence of an unspent digital balance does not create electronic-money safeguarding or deposit obligations.

If the original purchase is refunded, corresponding unused credits or benefits may be reversed to prevent a customer retaining both the goods and payment. We assess any already used portion fairly and within the law, particularly where the seller was responsible for a defect. Where the platform retires a paid feature before its promised period or reasonable usable life, the appropriate remedy is considered independently from voluntary closure.

The treatment of gifts differs from unused Tokens: a gift already sent can leave a message or record in the recipient’s profile, and we may not be able lawfully to remove the recipient’s copy. Closure extinguishes the purchaser’s further licence to use unsent or unspent goods, but does not authorise alteration of another person’s private conversation. A legal reimbursement is assessed independently of technical deletion or balance reversal.

10. Guest access, minors, dormant accounts and inactivity

The Service is for people aged at least 18; minors are not authorised to hold Accounts or buy tokens, likes or gifts, and a parent cannot open an adult dating profile on a child's behalf. We may restrict a suspected underage Account and consider any unauthorised payment under applicable law. Core purchases and member features are linked to an Account rather than a guest shipping order. A user who never completes account registration should not rely on payment alone to establish that creates an accessible profile; the operator must nonetheless reconcile any payment captured during an incomplete registration flow. Inactivity may prompt additional authentication, security checks or eventual closure under published service rules, with attention to pending funds and legal claims.

We may review an Account after prolonged inactivity, with a general 24-month activity horizon used for privacy retention planning. Closure due to inactivity should be reasonably notified when the contact address remains available and should not silently create new charges. A previously cancelled membership must not be reactivated simply because a dormant member signs back in. Restoring an Account may not restore digital benefits that expired under valid terms.

11. Deletion of personal data versus closure of access

Closing account access and deleting personal data are separate operations. Terminating access can immediately prevent profile display or messaging, while the privacy deletion workflow must assess backups, records held by other message recipients, fraud investigations and statutory financial retention. A request for erasure may be made through info@datefoundry.com even after the user loses login access, subject to proportionate identity verification.

The Privacy Policy explains rights to access, correction, restriction and erasure, together with categories that may be retained for legal obligations or the defence of claims. We do not condition account closure on waiving privacy rights. Conversely, a request to remove ordinary profile content does not necessarily nullify a transaction already in the process of refund or chargeback review.

12. Service retirement, major changes and sunset

If DateFoundry permanently closes a feature or the Service, we will consider what outstanding paid obligations remain and communicate material information through available channels when reasonably practicable. A user who paid for a continuing service or still-useful entitlement may be entitled to a substitute, proportionate price reduction or refund according to the contract and consumer law. We do not treat platform retirement as a universal right to retain unperformed payments without remedy.

A change to matching algorithms, interface layout or moderation design may be necessary for safety and does not always amount to contract termination. However, replacing a material paid feature with an inferior or unusable one requires separate consideration. The operator should preserve appropriate transaction and credit records long enough to reconcile outstanding claims after the shutdown.

13. Cooling-off and mandatory consumer rights

Eligible online distance contracts ordinarily carry a 14-day cancellation right measured from conclusion of the contract, subject to legal exceptions and the category of supply. For digital content not supplied on a tangible medium, early supply can remove that particular right only when the consumer gives express prior consent, acknowledges that the right will be lost, the supply begins lawfully and the required confirmation is given. An unselected general registration box is not a substitute for the relevant informed choice. The treatment of services and memberships can differ from that of an instantly credited token pack.

These rules do not remove remedies under the Consumer Rights Act 2015 for digital content that is not of satisfactory quality, fit for its purpose or as described. We will assess an eligible cancellation separately from the cessation of account access and reimburse within mandatory legal time limits where required. If another jurisdiction gives a consumer compulsory additional protection, this Policy does not override it.

For intangible digital content, the statutory withdrawal analysis concerns whether early supply began after express prior consent and acknowledgement and the required confirmation was provided. A time-based service or membership can have different early-performance and proportionate-payment consequences, so it is not automatically categorised as content delivered in full on day one. The Consumer Rights Act 2015 continues to protect against non-conforming digital content and deficient services irrespective of an applicable cooling-off exception.

14. Reopening, restoration and new accounts

A user may request reopening after voluntary closure, but restoration is not guaranteed: archived data may have been deleted, the Account name reassigned or a safety restriction may lawfully remain. We may require fresh age and identity checks and a new acceptance of current terms. Reopening should not automatically reinstate a cancelled membership, reactivate a stored payment authority or silently charge a previous card. Any new paid contract requires the applicable fresh purchase process.

A terminated member cannot evade a justified safety restriction through a new profile, another person's Account or a false identity. Someone who believes the restriction was mistaken should use the appeal channel instead. We do not restore reversed, refunded or extinguished virtual units merely because access is re-established, unless a correction is legally or contractually required.

15. Communications and support

Send closure, membership cancellation and statutory cancellation requests to info@datefoundry.com. Clearly identify the type of action, the Account email, the relevant order if applicable and whether you seek a refund or data erasure as separate remedies. We aim to acknowledge routine requests within two Business Days and complete straightforward account actions within ten Business Days after adequate verification, without imposing unnecessary steps that obstruct a timely statutory right.

For a card renewal approaching imminently, make the subject line “Stop future renewal” and state the renewal date if visible. Preserve confirmations and check subsequent bank statements. A support response should distinguish what has been cancelled, when future payments cease, how previously paid access is treated and which privacy records may remain.

An instruction that identifies the Account or subscription and unequivocally asks to stop future renewal should not be rejected merely for omitting a preferred subject-line label. We will take proportionate steps to verify authority without using that process to impose additional renewals. The confirmation should separately state whether a statutory cancellation, renewal stop, access closure or privacy deletion request has been recorded.

16. Changes to this Policy

We may update this Policy to address new account controls, service plans or legal developments. A later amendment cannot retroactively create an undisclosed renewal obligation, remove a completed cancellation or extinguish statutory rights linked to an earlier purchase. Material changes to an existing paid service should be communicated appropriately, including their effect on future charges and available remedies.

A user who disagrees with an adverse proposed change may request closure and the review of any legal refund entitlement. The current published text identifies the prospective rules, while the order-specific terms and disclosures accepted at the time remain relevant to earlier transactions. We maintain appropriate records of effective cancellation instructions.

17. Governing law and contact

This Policy is governed by the laws of England and Wales, without excluding mandatory consumer rights or access to competent courts elsewhere where required. The contracting operator is AMORIAX LTD, company number 17502222, trading as DateFoundry. Registered office: 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. Support and notices: info@datefoundry.com.

You may contact your card issuer about an unrecognised charge or dispute and the UK Information Commissioner's Office about a data protection concern. We encourage customers to tell us about resolvable errors, but no informal procedure is a precondition to exercising a compulsory right. Include a case number in any escalation so your previous instructions can be accurately traced.

18. Practical Outcomes Matrix

If you voluntarily close an Account after using a token pack, the Account and remaining units ordinarily cease; a refund is not automatic, but any statutory defect claim survives. If a distinct Paid Membership is cancelled before its next renewal, further renewal charges should stop, while already-paid access may remain through the current period as disclosed and lawful. If we suspend the Account for a credible safety concern, we assess whether the restriction is temporary and whether a paid entitlement remains deliverable.

Where a refund for a duplicated credit purchase is approved, money is returned to the original method and linked unused credits are reversed. If a user asks for privacy erasure during a chargeback, ordinary profile material is handled under the Privacy Policy while a limited transaction and dispute record may be retained. Every scenario requires identification of the particular contract and legal right rather than a single blanket rule that all closures or all digital purchases are non-refundable.
