1. About these Terms

These Terms & Conditions govern your access to DateFoundry, the dating and social-discovery service operated under the DateFoundry brand by AMORIAX LTD. They cover account creation, profile search, matching, messaging, digital purchases and the limited licences associated with tokens, packs of likes and virtual gifts. These Terms form part of your contract with the operator when you register or use the Service; an additional purchase contract is formed only when an order is accepted under the checkout process. Read the applicable product description before paying, because the functionality and expiry conditions of individual entitlements may differ.

These Terms should be read alongside the Privacy Policy, Cookie Policy, Refund Policy, Payment Policy, Cancellation Policy, Digital Product Fulfilment Policy and Acceptable Use Policy. Where a more specific policy addresses a particular issue, it supplements rather than cancels these Terms. A mandatory consumer right takes precedence over any inconsistent provision. DateFoundry is a platform for introductions, not a matchmaking guarantee, employment service, regulated financial service or emergency-response service.

The product-specific order page is part of the information on which you decide to buy. It must identify the seller, the precise digital action or quantity, limitations, total payable amount and settlement currency before a button carrying an obligation to pay is used. General website marketing does not replace those checkout particulars. Where the advertised item and the checkout summary conflict, pause the purchase and seek clarification rather than relying on a promotional illustration as a contractual guarantee.

2. Definitions

“Account” means the individual login and associated profile through which a person uses DateFoundry. “Service” means the website, account facilities, matching and messaging tools and virtual features made available by DateFoundry. “Tokens” means account-bound units usable for designated on-platform actions at the rates displayed before a particular action. A “Like Pack” supplies a stated quantity of digital interactions, and a “Virtual Gift” is an on-screen expression usable within the Service; neither gives the recipient an entitlement to real-world payment. “Digital Entitlement” means access, units, functions or items added to an Account following a valid purchase.

“Order” is an instruction to purchase a specific product at the displayed total and currency, and “Delivery” occurs when a usable entitlement has been recorded against the correct Account and made accessible through the applicable interface. “Paid Membership” means an optional time-based service only where a separate order page expressly offers it. “Business Day” means Monday through Friday, excluding public holidays in England. References to legislation and rights include any non-excludable local protections applying to a consumer.

3. Eligibility, age and account use

DateFoundry is intended exclusively for people aged at least 18. By registering, you confirm your age, legal capacity to enter a consumer contract and ability to pay with an authorised payment instrument. A parent or guardian cannot register an underage person in their place. We may reasonably request age or identity checks to protect members, investigate a credible report or comply with law, and may restrict access while reviewing information. Such verification does not establish that every other member is genuine or safe.

Keep credentials confidential; do not sell, lend or share your Account. You are responsible for activities you knowingly authorise, but this does not remove statutory rights regarding unauthorised transactions or security failures. Notify info@datefoundry.com promptly if your Account may be compromised. Your profile information should remain current; misrepresenting your identity, age, relationship status or intentions may justify proportionate restrictions under the Acceptable Use Policy.

Because this is an adult dating environment, age eligibility applies not just to purchases but also to public profiles, private messages and the ability to receive virtual gifts. An account restriction for suspected underage access is protective, not an assertion that the user committed fraud. An innocent payer may still seek correction of an unauthorised or wrongly processed order under the Refund Policy.

4. Scope of licence and permitted use

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access the Service and use purchased digital functions for private, non-commercial dating and social interaction. The licence does not transfer ownership of software, marks, designs, matching methods or other platform assets. You may view member content only as authorised by the Service; copying profiles to external databases or training systems is prohibited without an applicable legal basis and permission.

Purchased Digital Entitlements give access to the specified in-platform functionality while the relevant Account and feature remain available, subject to any clearly disclosed validity term. Revocation for misconduct must be proportionate and does not remove accrued statutory remedies where the operator failed to supply conforming digital content. We may use technical limits to prevent automated activity, excessive messaging and abuse of promotional quotas.

5. Virtual currency, items and digital content

Tokens, likes and gifts are units of platform functionality. They are not money, electronic money, bank deposits, securities, investments, prepaid cash balances or a payment instrument; they cannot be withdrawn, cashed out, exchanged for fiat currency or redeemed with a third party. The number of units, intended function and any disclosed expiry are defined by the product display at checkout. Any purchase of a gift provides the ability to send the digital representation, not a physical item or a guaranteed message response.

A recipient obtains only the interaction or visual acknowledgement permitted by the platform. Buying more likes or gifts does not improve eligibility, override another member's consent or ensure a particular match. We may correct obvious ledger errors, duplicate credits and fraudulent creation of units while maintaining order records and a fair complaints route. For approved refunds, related unspent units and benefits may be reversed; any treatment of consumed units is determined by applicable law and the resolution of the underlying defect.

A Token is counted as consumed when the purchased action is successfully executed by the platform, not merely because a button was pressed or a balance appears lower. A Like Pack is consumed only in respect of interactions registered as sent; a gift is consumed when the defined gift-sending action has successfully completed. If the intended function fails after debit, we will examine the action log and restore the unit or provide the remedy required by law. The recipient retains full control over whether to interact; purchased actions confer no priority over another member’s consent.

6. Purchases, billing and taxes

Before a payment is authorised, the checkout should identify the product, units or duration, available features, billing currency, total charge including applicable taxes, payment method and whether the purchase is one-time or recurring. A selector showing an estimated currency is not a promise that the issuer will settle in that currency; the final checkout total is the controlling purchase information. Review it carefully and refrain from proceeding if the price or unit count appears wrong. A confirmation email or account receipt should identify the transaction and purchase.

An order is accepted when payment is successfully authorised and the order is confirmed. We can refuse a transaction for reasonable fraud, legal or technical reasons, returning any captured amount as required. Purchasing a bundle does not enrol you in recurring billing. If a Paid Membership is offered separately, automatic renewal may occur only where the order prominently specifies its price, frequency, duration, cancellation method and the customer's affirmative agreement. The Payment Policy governs processing and disputes.

An optional membership is a separate type of contract from the purchase of a Token, Like Pack or Virtual Gift. A one-time purchase does not authorise saving card credentials for future charges or enrolling the buyer in a trial that becomes paid. Any recurring arrangement must be presented and accepted on its own terms, with a recognisable cancellation route and clear information about each future charge. We will not rely on the existence of a profile or a general terms acceptance as proof of subscription consent.

7. Delivery of digital content

Digital products are supplied online by crediting units, opening the purchased action or displaying an activated membership benefit within the Account. There is no parcel, courier, shipping fee or shipping address required for these products. The Digital Product Fulfilment Policy explains completion evidence, pending payment authorisations, delayed credits and the response to a technical failure. A bank notification alone does not prove that the purchase was delivered; the platform must be able to associate the accepted transaction with a usable entitlement.

Most successfully completed orders are expected to become available promptly, normally within 15 minutes; security screening or third-party downtime may delay access. If the purchase remains unavailable after 24 hours, contact support with the order identifier rather than making repeated purchases. A paid digital item that cannot be supplied will be corrected or remedied under the Refund Policy and mandatory consumer law.

Where a buyer requests immediate supply of intangible digital content before the end of a statutory cancellation period, we will obtain the legally required express prior consent and acknowledgement of the resulting loss of that cancellation right, and record these in the durable purchase confirmation. Without those conditions, we will not treat access or crediting alone as a valid waiver. A continuously supplied digital service or paid membership may engage separate cancellation and payment rules and must not be treated as an instant digital unit merely for convenience.

8. No redemption, resale or cash-out

Users may not transfer, resell, barter, collateralise or trade Accounts, token balances, likes or gifts for real-world value. Third-party advertisements purporting to buy or convert DateFoundry credits are not authorised. Promotional units cannot be sold, pooled between multiple Accounts or obtained through referral manipulation. Attempted off-platform dealing may result in suspension of relevant functions, reversal of illegitimate balances and investigation under the Acceptable Use Policy.

These restrictions concern the licensed digital function, not a person's right to recover money for an unlawful charge, faulty content or properly exercised cancellation. Neither closure nor expiry normally converts remaining units into a financial claim, but the operator will assess any statutory remedy separately. If a feature is permanently withdrawn after a paid purchase, we will review whether a meaningful substitute or appropriate reimbursement is legally required.

9. User conduct and prohibited activity

Use the platform respectfully and only to engage with adults who can freely decide whether to communicate. Do not harass, stalk, threaten, blackmail, solicit money through deception, impersonate another person, distribute intimate images without consent, or pressure someone to move a conversation off-platform. Unsolicited commercial messages, phishing links, coordinated manipulation, bulk extraction of member data and bypassing safety blocks are not allowed. The Acceptable Use Policy sets out enforcement options and reporting procedures.

Do not use gifts or tokens to create an expectation of sexual access, preferential treatment or an obligation to reply. A purchased interaction is a platform capability, not consent from a recipient. We may preserve and review relevant reports and transaction evidence proportionately when investigating abuse or a credible legal request, in accordance with the Privacy Policy.

10. User-generated submissions

You retain ownership of original text, photos and other content you submit. You grant us a non-exclusive licence to host, process, display and technically adapt that content only insofar as reasonably necessary to provide, secure and improve the Service, subject to your profile visibility settings and privacy choices. You must have the right to upload the content and must not use another person's likeness, private communications or intellectual property unlawfully.

Other members may see content within the visibility you choose; avoid publishing home addresses, financial information or intimate material you would not want disclosed. We may remove content that violates these Terms, infringes rights or presents a credible safety risk. Removal of content does not automatically erase legally retained reports, fraud evidence or records needed to establish contractual compliance. Requests about erasure are handled under the Privacy Policy.

A submitted photograph or message must be one you are entitled to post. Your permission to DateFoundry is limited to what is needed to host, present, transmit, moderate and technically maintain the Service, consistent with profile controls and the Privacy Policy. Public visibility is not permission for other members to redistribute intimate content; reporting a concern does not require the victim to publish additional sensitive images.

11. Intellectual property

The DateFoundry name, interface, service design, code, branding and original platform content are owned by or licensed to the operator. Except for the express licence above, no rights are granted to reproduce, distribute, reverse engineer or commercially exploit the Service. Your lawful personal use of the Service and any mandatory rights concerning interoperability or reverse engineering remain unaffected.

If you believe your rights are infringed, write to info@datefoundry.com identifying the specific material, the rights relied upon, your contact information and the action requested. We will assess sufficiently particularised notices and may remove or restrict disputed content without pre-judging ownership. Repeated knowingly false infringement reports may breach the Acceptable Use Policy.

12. Updates, maintenance and changes to the Service

We may release security updates, repair vulnerabilities, improve matching controls or change interface elements. Temporary outages can occur for planned maintenance, provider failure or safety incidents; where practicable we communicate significant interruptions through the website or account notifications. We will not silently replace a paid product with a materially inferior feature during its agreed period without evaluating the affected customer's legal rights.

Substantial adverse changes to a paid service may justify an alternative, proportionate reimbursement or cancellation where law requires. User conduct rules and safety controls may be updated to respond to new abuse patterns, provided changes are reasonable and published. Your continued use after notice of an ordinary change does not waive claims arising from prior purchases.

13. Suspension, restriction and termination

We may restrict an Account, message function, payment capability or specific content where reasonably necessary to address suspected fraud, harassment, underage use, a security compromise, legal demand or material breach. We consider severity, available evidence and safety risks, and may act immediately where delay could harm another person. Where safe and lawful, we explain the principal reason and offer a contact path to challenge an error.

You may close your Account through any available account controls or by writing from the registered email to support. On closure, access and unused licensed entitlements ordinarily end and are not transferable. That rule does not remove a valid claim for non-delivery, defective content, mistaken charge or applicable cancellation. The Cancellation Policy describes account closure, any Paid Membership termination and data deletion as separate processes.

If access is restricted for safety or suspected fraud, we will consider the type of allegation, evidence, urgency and effect on paid benefits. A restriction must not be used to defeat a legitimate chargeback or statutory remedy. We will retain enough relevant records to address a reasonable appeal and to reconcile entitlements, subject to privacy safeguards and law.

14. Consumer rights and statutory protections

Consumers in the United Kingdom have rights under the Consumer Rights Act 2015 relating to digital content supplied as described, of satisfactory quality and fit for its relevant purpose. If digital content fails those standards, the law may provide repair, replacement, price reduction or reimbursement depending on the circumstances. Nothing in these Terms excludes, limits or makes unreasonably difficult those remedies, and a label such as “non-refundable” cannot cancel a statutory right.

A consumer buying a time-based service is not treated as having consumed the entire service merely because an account became available on the first day. Requests involving an optional membership or ongoing service are assessed under the service-specific withdrawal and cancellation rules, including any legally required payment for performance already requested. Further compulsory rights may apply under the consumer's country of habitual residence.

For a distance contract, the ordinary 14-day cancellation framework depends on whether the supply is intangible digital content or an ongoing service. Immediate delivery does not automatically remove the right. For digital content, we rely on loss of the cancellation right only after express prior consent, clear acknowledgement before supply begins and the confirmation required on a durable medium. Statutory conformity remedies under the Consumer Rights Act 2015 remain separately available even if that cancellation right has ended.

15. Refunds and billing disputes

Submit a purchase concern to info@datefoundry.com with the account identifier, transaction date, amount, currency, order or receipt number and an explanation of the problem. We aim to acknowledge the claim within two Business Days and give a reasoned decision within ten Business Days after receiving sufficient information. A statutory reimbursement deadline prevails where shorter or otherwise mandatory. Approved card refunds ordinarily return to the original payment instrument, with settlement controlled partly by the issuer.

The Refund Policy supplies the detailed procedure for delivery failure, duplicate charging, unauthorised payments and failed entitlements. You may also exercise rights through your card issuer or payment provider; seeking help from DateFoundry first is encouraged but not a condition of those rights. We may provide accurate transaction and delivery records when responding to a scheme inquiry while respecting data-protection duties.

16. Disclaimers and service availability

DateFoundry provides tools for meeting other adults; we cannot guarantee the identity, honesty, availability, intentions, compatibility or future conduct of another member, or any number of replies, dates or relationships. Members are responsible for choosing whether and when to exchange information or meet. Use public meeting places, tell a trusted person your plans and never transfer money because a contact requests it. If you face immediate danger, contact emergency services rather than relying on platform messaging.

We take reasonable steps to operate and secure the Service but cannot promise uninterrupted connectivity or a particular matching outcome. These qualifications do not diminish warranties, performance standards or remedies imposed by consumer law, or our responsibility for failing to exercise legally required care and skill.

17. Limitation of liability

Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded. We remain responsible for foreseeable loss caused by our breach or failure to use reasonable care and skill. We are not liable for losses that were not reasonably foreseeable when the contract was formed, except where the law requires otherwise. These Terms do not attempt to make consumers bear a disproportionate risk for our own contractual failures.

DateFoundry is intended for individual personal use, so losses arising solely from unauthorised commercial exploitation are outside the ordinary consumer bargain, subject to compulsory law. A customer's responsibility for losses caused by their own deliberate misconduct is assessed fairly and cannot be treated as a blanket release of the operator from statutory obligations.

18. Indemnity

Where legally permitted, you are responsible for direct and reasonably evidenced costs resulting from your intentional infringement of another person's rights, fraudulent acts or deliberate material violation of these Terms. We will not seek reimbursement merely because you make an honest complaint, exercise a data protection right, seek a statutory refund or raise a good-faith card dispute.

Any claim will take account of causation, reasonable mitigation and applicable consumer protections. We will notify you of the substance of a claim where feasible and will not require you to fund penalties or costs attributable to our own negligence or misconduct. This clause must not be read as an unlimited indemnity from a consumer.

19. Privacy, cookies and data handling

We process account, preference, content, technical, payment-reference and safety data to operate the Service. Dating fields and conversations may disclose religion, sexual orientation, sex life or other sensitive characteristics, even when those fields are not expressly requested. Our Privacy Policy explains purposes, lawful bases, special-category conditions, sharing, retention and rights. Choices about profile visibility are distinct from consent for optional processing; an agreement to these Terms does not substitute for any required explicit consent.

The Cookie Policy describes necessary session tools and optional tracking, including the preference controls applicable to your device. No non-essential technology is authorised merely because you created an Account. You should avoid posting other people's sensitive personal data without their consent or another legitimate basis.

20. Complaints and support

For safety, delivery, billing or contractual issues contact info@datefoundry.com with enough detail to locate the relevant Account, transaction or content. We will separate urgent safety reports from routine billing cases and may request proportionate verification before disclosing private records or changing an Account. Preserve any receipt or relevant screenshots; do not email complete card numbers, passwords or intimate third-party material unless specifically required by a secure reporting process.

If our first response does not resolve the issue, reply with the case reference and the remedy sought so it can be reconsidered. Consumers retain the right to use statutory dispute procedures, complain to competent regulators and pursue legal remedies. We do not require a customer to withdraw a lawful chargeback as a condition of support.

Report a fake profile, coercive message or attempted romance scam through the available reporting mechanism or the support email. Include the profile or message reference where possible, rather than publishing the allegation or sharing a target’s intimate media. The company assesses reports proportionately, may use preservation controls for credible harm and may refer unlawful conduct to competent authorities where legally justified.

21. Governing law and dispute resolution

These Terms are governed by the laws of England and Wales. Courts of England and Wales may hear disputes, subject to any mandatory rights of consumers to bring proceedings in their place of residence or rely upon compulsory protections under applicable law. Before starting proceedings, either side may propose a reasonable good-faith resolution through the support address, without shortening limitation periods or preventing access to a court or regulator.

If any provision is ineffective under mandatory law, the remaining provisions continue only insofar as they can operate fairly and lawfully. A failure to enforce a provision on one occasion does not remove the right to enforce it appropriately later. Legal notices to the operator may be sent to the registered office in the Operator table.

22. Changes to these Terms

We may publish a revised version to reflect new features, security needs, operational changes or legal developments. For material changes to an existing paid obligation, we will provide reasonable prior notice where practicable and explain the impact on rights, price or available cancellation. The version in force when an Order was accepted remains relevant to that Order unless a lawful and properly disclosed variation applies.

Ordinary continued access following an appropriate notice may indicate acceptance of prospective changes, but cannot create undisclosed recurrent payment consent or waive already accrued rights. If a proposed change materially disadvantages you, contact support to discuss options including closure and any legally required remedy.

23. Contact

The contracting operator is AMORIAX LTD, company number 17502222, trading as DateFoundry, with its registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. Consumer questions, safety reports, cancellation requests, complaints and privacy contacts may be addressed to info@datefoundry.com. This email channel does not replace law enforcement or emergency reporting where immediate protection is needed.

Include the subject of the request, your registered account email and a transaction reference where appropriate. To protect users, we may ask for verification before changing sensitive settings or responding with another person's information. We aim to handle routine communications promptly, while taking the additional time reasonably needed to investigate complex safety or technical matters.

24. Schedule 1 – Practical service rules

Before buying, check whether the offer is a one-time token/like/gift package or a separately presented paid membership. Look for the exact number of units, available actions, total price and settlement currency, and the applicable cooling-off information. An entitlement becomes available in your Account rather than arriving in the post; if the displayed balance is unchanged, preserve the receipt and report it instead of repurchasing immediately.

When interacting with another member, remember that a like or virtual gift is not a promise of attention. Do not request reimbursement from the recipient for gifts, pressure anyone to respond, or share another person's photographs outside DateFoundry. If you suspect a romance scam, stop communication, report the profile and contact your financial institution if you made a separate off-platform payment.

Before closing your Account, review the Cancellation Policy and preserve the information you are entitled to keep. Unused credits ordinarily cease with access; a lawful refund claim is assessed separately. Use the Privacy Policy process to request personal data access or erasure, noting that the operator may need to retain limited evidence of disputes or safeguarding events. In any conflict between these practical examples and mandatory law, the legal right prevails.
